Last Month, the DOE released the Educational Impact Statement proposing the phase-out of M.S. 571 - The Bergen Upper School and a re-siting and co-location of Brooklyn East Collegiate Charter School in the 13K009 building. The DOE claims M.S. 571 “lacks the capacity to turn around” and there’s a need of high-quality options in school district 13. Much like P.S. 316 and M.S. 353, the DOE is not allowing the possible expansion and growth of P.S. 9.
The community knows each of these schools was never given the chance to succeed and grow. We demand that chance!

Inaugural Cinema Festival Begins Black History Month: ActNow, Council Member James & BAMcinematek
Inaugural Festival by Brooklyn-Based Film Organization Opens Up Black History Month 2011 at BAMcinèmatek
Brooklyn, NY - Fort Greene based ActNow Foundation, in conjunction with BAMcinématek and NYC Council Member Letitia James, presents a new film festival that directly reflects the wide spectrum of views and themes within the African diaspora communities in Brooklyn and beyond.
The New Voices in Black Cinema Festival is a multi-genre showcase of quality movies geared towards getting general and new audiences to appreciate Black independent film. Choosing excellence over spectacle and boldness over standard fare, this program pushes the gamut of showing how film explores Black society and provides exhibition to new voices, and existing ones.
Taking place February 4th to the 9th at BAM Rose Cinemas, this program is an extension of ActNow’s ongoing New Voices in Black Cinema screening series at BAMcinèmatek, which last summer premiered Idris Elba & Thomas Ikimi’s festival hit Legacy and in 2009 showed the stirring documentary on soul music legend Bill Withers, Still Bill. “This festival continues ActNow’s mission of giving independent filmmakers the opportunity to present their stories to audiences on a grand scale,” proclaims ActNow Executive Director Aaron Ingram. He continues, “Especially being in Brooklyn, they’ll be able to reach out to our borough’s diverse African diaspora and beyond.”
New Voices in Black Cinema features documentary films of cultural and socio-political significance like Coming Back For More (2009—Feb. 5 & 6), in which the search for reclusive soul music superstar Sly Stone takes documentary filmmaker & musician Willem Alkema on a memorable, musical journey of a lifetime. Heart of Stone (2009—screening Feb. 4 & 9), examines Newark’s Weequahic High School principal Ron Stone’s efforts in confronting the extra-violent gang problems in his school and the backlash from the once-proud Jewish alumni in what was once among the highest-rated schools in the USA and journalist Dream Hampton’s documentary Black August (2010—Feb. 4 & 6), showcases a grassroots movement’s efforts to raise awareness about political prisoners, featuring interviews with intellectuals and social activists such as Assata Shakur, as well as performances by Hip-Hop artists such as Brooklyn natives Mos Def and Talib Kweli.
The series also includes personal narrative films like Money Matters (2010—Feb. 7), award-winning filmmaker Ryan Richmond’s portrayal of a single mother and her teenage daughter, as well as Tanya Hamilton’s Night Catches Us (2010—Feb. 4 & 7)—named one of the Best First Features in The Village Voice 2010 Film Critics’ Poll—starring Anthony Mackie and Kerry Washington, about a former member of the Black Power movement returning home. Robert Heath’s SUS (2010—Feb. 4 & 7) a “sharply written, beautifully acted, and devastating critique of institutional racism,” (David Edwards, Daily Mirror) set entirely in a British interrogation room on election night in 1979, centers on two bigoted cops attempting to pin a murder on a man, played by Clint Dyer, who also produced.
The festival concludes on Feb. 9 with the ‘Brooklyn Block’ showcase of short films from local filmmakers, as well as a screening of Wendell B. Harris’ newly-restored Chameleon Street (1990—Feb. 9), inaugurating ActNow’s New Black Classics series. This race-examining satire based on the life of William Douglas Street, Jr.—played by the director himself—a Detroit con artist who successfully impersonated numerous professionals, became the first black film ever awarded Sundance Film Festival’s Grand Jury Prize in 1990.

Statement from Council Member Letitia James regarding the Perpetual Replacement and Co-location of Traditional Public Schools with Charter Schools
“The recently leaked document from the Department of Education is causing reasonable uproar from parents and schools throughout New York City. The DOE’s outline to replace twenty-six schools this year - with mainly charter schools - proves that no neighborhood is safe from the unilateral decision making of Mayor Bloomberg and now, Chancellor Cathie Black.
The 26 schools recommended for closure due to poor performance has received little to no support from the DOE for restructuring or developmental purposes. P.S. 9 – Teunis G. Bergen/M.S. 571 and P.S. 316 – Elijah Stroud/M.S. 353 – Elijah Stroud Middle School – all in my district – are being threatened with a co-location of charter schools, in addition, to a proposed phase-out of M.S. 571. Also, P.S. 11 – Purvis J. Behan seems to be targeted by the DOE as a possible place for co-location due to their outdated underutilized space report. Although these decisions are subject to public hearings and a vote by the Panel for Educational Policy, these students and their families are losing confidence in the NYC public education system.
I propose that the DOE allow restructuring of the M.S. 571 administration as it is necessary to maintain middle school options in school district 13. P.S. 316 has grown tremendously over these years under the great leadership of Principal Elif Gure-Perez and M.S. 353 is now a part of the Middle School Choice process of which will attract at least 100 additional students for the 2011-2012 school year. Both schools maintain levels of proficiency and received an “A” grade on their DOE 2009-2010 progress reports. Allow these schools to blossom in a time when they are both exceeding expectations and gaining community support.
The charter revision and expansion for Community Roots Charter School in Fort Greene, Brooklyn, for example, is one well deserved. However, the placement of the school in a separate building with another traditional school will only invite further public scrutiny. It is undoubtedly irresponsible for the DOE to take it upon themselves to create such documents without the input of the adjoining communities.
Once a phase-out is fully implemented, the DOE will cease to allocate funds to the closing school and repurpose all remaining funds to the incoming school. The Fair Student Funding (FSF) covers basic instructional expenses and may be used to hire staff, purchase supplies and materials, or implement instructional programs. As a result of the phase-out, the total number of students enrolled at the closing school will naturally decline each year resulting in fewer teachers and supplies to meet the needs of the remaining student population. The DOE needs to understand that many of these existing schools are community staples. It is without argument that many need support to maintain desirable proficiency and retention rates. Nevertheless, replacing them and reallocating resources to new charter schools is NOT the solution.”

On Sunday, January 9th, 2011 at 12:15AM, 3 men were shot in front of 801 Dean Street.
(1) Victim- Male, Black, 19 years old was shot one time and was taken to Kings County Hospital for his injuries.
(2) Victim- Male, Black, 22 years old was shot one time and was taken to Kings County Hospital for his injuries.
(3)Victim- Male, Black, 18 years old was shot one time and was taken to Kings County Hospital for his injuries.
The perpetrator for each of these victims is unknown at this time. The case is under investigation with the 77th Precinct Detective Squad. FGA Celebrates Black History Month- Call for Artists
For the month of February, The Fort Greene Association (FGA) will salute the contributions of African-Americans who’ve made significant contributions in and around Fort Greene; individuals who’ve committed selfless acts as well as recognize pioneers who’ve paved the way for others. The FGA is seeking artists interested in donating their time and talent to create Black History Month window displays/murals in the windows of local Fort Greene businesses to be exhibited for the month of February.

The New York City Office of Emergency Management (OEM) issued a Hazardous Travel Advisory due to a forecasted snow storm that will cause dangerous travel conditions for Friday, January 21st. The National Weather Service has forecast between 3-6 inches of snow during the night of Thursday, January 20th. OEM strongly recommends that people use mass transit and avoid driving during and immediately after the snow storm.
Alternate Side Parking (ASP) regulations will be suspended Citywide on Friday, January 21 to facilitate snow removal. Payment at parking meters will remain in effect throughout the City.
Shooting In Front of BK High School On MLK Holiday

(Brooklyn, NY) Five teenagers were shot last Friday night around 10pm after a basketball game in Clinton Hill, Brooklyn between Bishop Loughlin Memorial High School and Christ the King High School. The victims and locations of wounds include: an 18 year old female in the left foot; an 18 year old male in the left foot; a 19 year old male in the hip, calf, and buttock; a 17 year old male in the right ankle; and a19 year old male in the left arm. The shooting occurred in front of Bishop Loughlin Memorial High School, between Greene and Vanderbilt Avenues.
In a letter from Bishop Loughlin's President, Brother Dennis Cronin, regarding last Friday evening’s shooting he said: “We at Loughlin are deeply grieved by the random street violence that occurred in front of the school on Friday night. I am relieved to report that no Loughlin student was involved in this incident. We extend our sympathy to the families and young people who were injured by this senseless and random violence. It is a violation of our school community, the safety we seek to secure, and the values we work to instill in those entrusted to our care.”
4 victims were transported to Kings County Hospital, and 1 male victim walked into Brooklyn hospital. According to reports, none of the injuries were life threatening, and immediately following the shooting all were in stable condition. The 88th Police Precinct responded quickly with a strong presence and secured the area surrounding the school.
“I know from experience that most basketball games at Bishop Loughlin High School are peaceful. And, there was a police officer on the premises that evening. I’d like to assure the community this incident did not involve Bishop Loughlin or Christ the King High School students. Apparently, the fight may have broken out over a teenage girl, or a possible robbery motive,” said Council Member James. “I would like to hold a meeting with the leaders and basketball teams of both schools to discuss methods for security and protecting the students, as well as protecting the community and all visitors during and after basketball game nights.”

The Internal Revenue Service (IRS) has designated Friday, January 28, 2011 as Earned Income Tax Credit (EITC) Awareness Day. The goal of EITC Day is to increase public awareness of the EITC, which is a refundable credit for people who work but do not earn high incomes. It helps eligible taxpayers lower their taxes or receive funds. Both New York State and New York City have local versions of EITC. The IRS wants all eligible taxpayers to receive the EITC they deserve.

NYC Strategic Alliance for Health (SAfH) partners have developed the Excellence In School Wellness Award to publicly acknowledge and applaud schools that are champions in nutrition, physical activity and wellness. Urge DSNY to Communicate With Public About Circumstances Surrounding December Blizzard
New York, NY— On January 18, 2011, the New York City Council will hold the first in a number of borough-wide community hearings to discuss the December 26, 2010 snow blizzard. Today’s hearing will take place in Staten Island, NY.
These community hearings follow the New York City Council’s closed hearings on January 10, 2011 at which Deputy Mayor Stephen Goldsmith, as well as the commissioners from the Department of Sanitation, Department of Transportation, the Office of Emergency Management and Fire testified. The administration has elected not to send agency commissioners or supervisors to today’s hearing, and will send community affairs representatives to represent the Department of Sanitation (DSNY).
Council Member James, who chairs the Council’s Sanitation Committee, has been vocal about the December blizzard and the poor service to the outer-boroughs in comparison to Manhattan. It is of particular importance that officials from DSNY be present at these community hearings to communicate to the public the agency’s updated protocol for handling storms and weather emergencies.
“The department has made positive changes to ensure that Brooklyn and the outer boroughs aren’t ignored during future weather emergencies,” said Council Member Letitia James. “Both the commissioner and superintendents should be at the hearings to present these changes to the community. It is unacceptable to not afford the people of the City of New York the respect of a direct dialogue.”
“This isn't as much an insult to me as a Council Member as much as it is a display of limitless arrogance and disrespect to the people of Staten Island. Too bad every year isn't an election year,” said Minority Leader James Oddo (Staten Island)
“The Mayor’s decision not to send any commissioners or supervisors to the sanitation hearings in the outer boroughs is really the height of arrogance,” said Council Member Deborah Rose (Staten Island). “ Staten Islanders unnecessarily endured several days of chaos due to the ineptitude of the Administration, but the Mayor will not send those responsible to face the public for even a few hours. How can anyone say that the Administration is responsive to the needs of the people, when it refuses to even meet with them? Residents of the outer boroughs deserve better.”
The community hearings will take place in each borough throughout this week.

If Martin Luther King Jr. and Malcolm X had a conversation what would they have said? That fictitious 1965 meeting is the subject of the award-winning play by Jeff Stetson. These two iconic figures of the civil rights movement come to life this Thursday at Kumble Theater. Check it out!

The Meeting is an engaging & intelligent play that depicts a fictional account of a secret meeting between Malcolm X & Dr. Martin Luther King, Jr. Following the bombing of Malcolm X's home and shortly before he was assassinated, Malcolm and Martin meet in a room inside the historic Theresa Hotel. They were two men with different ideologies, but a common understanding of the plight of Black America.

NYCC Sanitation Hearing Discussed at Good Day NY; CMs Crowley and Williams Interviewed
Council Member James regarding some of the comments made: "It is important to remember that there is a federal investigation happening at this time, and that it is not the duty (or within the jurisdiction) of the New York City Council to perform any criminal investigation of events. Nor would it helpful to feed into unsubstantiated claims."
"Instead, the goal of the Council hearing- laid out by myself before the hearing began- was to look into whether the Department of Sanitation failed in meeting its goals for snow management, and if so how the department and administration can ensure those mistakes are not repeated. It is imperative that in order to address those issues, comments and testimony be as focused as possible. In light of the administration's surprising admissions yesterday, and recent attempts to strengthen service, I feel as if yesterday's hearing was successful."

NYC DOE ANNOUNCES START OF KINDERGARTEN ADMISSIONS PROCESS
- Proof of residence. This consists of any two of the following documents:
- A residential utility bill (gas or electric) in the resident's name and dated within the last 60 days;
- Documentation or letter on letterhead from a federal, state, or local government agency indicating the resident's name and address and dated within the last 60 days;
- An original lease agreement, deed, or mortgage statement for the residence;
- A current property tax bill for the residence;
- A water bill for the residence dated within the last 60 days;
- Official payroll documentation from an employer dated within the last 60 days, such as a form submitted for tax withholding purposes or payroll receipt (a letter on the employer's letterhead will not be accepted);
- Child’s birth certificate or passport;
- Child’s immunization records;
- Names of any siblings who will be enrolled in grades 1-5 at the school in 2010-2011

Below is a partial legislative update from 2010. Our office looks forward to pushing these important policy priorities.
Int. 13-2010- Creation of a task force to combat youth violence.
Int. 197-2010- DOC to report on race/ethnicity, zip code of residence, precinct of arrest, and charged offense of adolescents admitted to city jails.
Int. 196-2010- DOC to develop a discharge plan for adolescents leaving city jails.
Res. 365-2010- Calling on NYS Legislature to more clearly define "public use, benefit, or purpose" in Eminent Domain Procedure Law.
Res. 116-2010- Calling on the Mayor to issue an Executive Order to require all NYC agencies to perform cost-effective analysis before contracting for personnel and professional service contracts.
Int, 286-2010- Establishing a temporary task force to review outsourcing (jobs, contracts, resources) by City agencies.
Res. 506-2010- Calling upon Animal Care and Control of NYC to establish a Citywide TNR Program for feral animals.
Res. 365-2010- Calling upon Congress to pass and POTUS to sign into law the Paycheck Fairness Act.
Int. 432-2010- Providing paid family leave to private employees.
Res. 582-2010- MTA to unlock doors between cars on NYC subway cars.
Upcoming bills--
-In relation to human rights in housing (addressing segregation in NYC housing- public)
-Calling on DOE and CUNY to develop standardized responses and protocal to address bullying and harassment in schools and colleges
-Requiring DOE to encourage enrollment to LYFE-DOE program for eligible teen parents; DOE to require standardized parenting training in LYFE centers; partnering with ACS to develop parental skills programs that include education on not leaving children with irresponsible or violent partners.

Department of Sanitation Not Resuming Full Garbage Collection by Monday, January 3
Brooklyn, NY— On Sunday, January 2, 2011, the New York City Department of Sanitation announced that after a week of halted garbage collection only limited collection would resume on Monday, January 3rd, and recycling collection would be halted indefinitely.
Following the snow blizzard that took place throughout New York City on Sunday, December 26, residential streets are overflowing with garbage, which risks attracting rodents and other vermin. Additionally, these conditions create a hazardous environment for pedestrians, particularly the disabled and elderly. Sidewalk access remains problematic, and walkways in some parts of the city are almost impassable. As the Department of Sanitation continues to remove a significant amount of the snow and ice, and with warmer temperatures melting the rest, resuming garbage collection should be the primary focus starting tomorrow.
“In the midst of last year’s snow storm, I commended the administration on addressing the sanitation issues that arose,” said Council Member Letitia James (D, NY) “This time, criticism is necessary. It is unacceptable that Brooklyn and the other outer boroughs didn’t receive adequate and timely storm clean-up. And it is frankly dangerous to continue to put off full garbage collection in these unsanitary conditions.”

STATEMENT BY COUNCIL MEMBER LETITIA JAMES ABOUT THE ADMINISTRATION’S RESPONSE TO THE DECEMBER 2010 SNOW STORM
“Days after the storm, snow in Brooklyn is still piled high and the streets are slick, and dangerous. Concerned neighbors and residents in the 35th Council District are reaching out to me questioning the delay of snow cleanup in Brooklyn. Apparently, the Administration has responded inadequately to the snowstorm, and streets are not passable to many in Brooklyn.
At this time, not enough snowplows are on the ground, and more cleanup efforts should be focused in the City’s outer boroughs. Also, car owners are complaining that vehicles are buried by snow; it’s difficult to locate cars, as well as dig cars out. Simply put, the failure of the Administration to declare a snow emergency was a major blunder.
As the Chair of the Council’s Sanitation Committee, I request more attention and help from the Administration during this snowstorm crisis. Specifically in Brooklyn to increase safety for drivers and residents as this holiday season continues, and families and friends gather to visit and celebrate.
I advise constituents to call 311 and keep a record of your complaint numbers, in order to ensure streets are plowed. And, I plan to hold hearings as Chair of the Sanitation Committee on this matter. Lastly, the Department of Sanitation is looking for day laborers and private equipment owners to remove snow; those interested should inquire with 311 as well.”
