Forest City Ratner (FCR) Companies and Council Member Letitia James are again providing free rodent-proof waste receptacles to 35th District residents.
The heavy-duty, plastic cans with lids are approved by the City's Department of Health.
The receptacles can be picked up at the District Office of Council Member James, 67 Hanson Place, between 9:30 a.m. and 5:30 p.m. Bring identification and proof of address when picking up, and call (718) 260-9191 to confirm availability.

As Council Member James joins her colleagues in speaking in support of residential parking permits today, we want to bring your attention to a petition created by Brooklyn Speaks (civic associations, community-based organizations, and advocacy groups concerned about the future of development at the Atlantic Yards site) in support of a residential permit parking program for New York City in conjunction with local communities and their representatives.An informal poll by Brownstoner also put the number of residents in support of an RPP near Barclay's at 83.6%.

According to the Empire State Development Corporation, when the Barclays Center opens in September 2012, an expected 35% of arena patrons, or as many as 5,600 cars will travel to the site for each of the projected 220 events held each year. If nothing is done before to mitigate this volume of traffic, there will be an increased risk of vehicular, pedestrian and bicycle accidents that already make Atlantic Avenue Brooklyn's most dangerous road. This barrage of traffic is also expected to cause significant delays at more than half of the intersections within a half mile of the arena. And it will result in almost 3,000 arena patrons taking curbside parking spots in Park Slope, Boerum Hill, Fort Greene, and Prospect Heights.
Among all of the impacts to neighborhood character and quality of life that will come from locating Atlantic Yards' arena within residential communities, none are of greater consequence to more residents than the traffic generated from arena events. But, there is a way to reduce the demand for our local streets. It's called "residential permit parking," or RPP, and it's been effective in other cities, like Boston and Chicago, where sports facilities are located in densely-populated areas. By limiting on-street parking during arena events to local residents, RPP will create a disincentive for arena patrons to drive, reducing congestion and making streets safer.
New York City requires authorization from the State legislature before it can implement RPP. On Wednesday, 11/2 at 10:30AM, the City Council will hear testimony on legislation authorizing the City to enact residential permit parking programs in the five boroughs.

CM James Comments on ESDC & FCR Appeal Of Court Decision On Ordering Additional Environmental Review Of AY Project

(Brooklyn, NY)— “The drawn out Atlantic Yards project in Prospect Heights has anguished local affordable housing advocates, and become a hardship to businesses, residents, pedestrians and drivers. Residents in the area remember when community voices first rose together against the corporate will of Bruce Ratner’s Atlantic Yards. This project from its inception has posed a series of threats to the community.
As time moves forward, the mounting distance of Ratner’s promises becomes more apparent with this project. Ratner is not delivering on the 2,250 affordable housing units he promised, and Ratner has not fulfilled his promise of 17,000 jobs for the community. Simply put, ESDC and FCRC have not delivered much to the community, and continue to do an injustice to central and downtown Brooklyn residents by disregarding their voices. Will any of the affordable housing and jobs expectations - promises that Ratner originally proposed ever come to pass?
Now, advocates for affordable housing around the Atlantic Yards site will just have to wait; this appears to be the message sent by the Empire State Development Corporation (ESDC) and Forest City Ratner Companies (FCRC) at this time. Surprisingly, they will fight a court decision made last July that ordered additional environmental review of the Atlantic Yards project (a ruling that came after two years of litigation, which protested ESDC's plans to increase the length of the projection construction from 10 years to 25 years).
In filing the appeal, the ESDC will now have no obligation to obey the court order voiding New York State Supreme Court Judge Marcy Friedman’s direction to slow down/stop construction until the state agency conducts a new phase of environmental review of the project, including a Supplemental Environmental Impact Statement (SEIS); as well as a determination on whether to approve the MGPP for Phase II of the project, which constitutes the bulk of the project.
This potentially means that FCRC is able to continue building the arena until the appeals court hears the case - which could take a year or longer. Again, the community’s wishes are simply not considered by the ESDC and FCRC, who see no problem to burden the community with 25 years of construction. FCRC and ESDC are showing once again their commitment to using corporate power to block the community.
An environmental review of the project provides checks and balances, and is a process to protect community. It is obvious that the ESDC and FCRC do not want to spend time and money on a Supplemental Environmental Impact Statement because they know other issues might come up that would need to be negotiated. Fighting the court decision ordering additional environmental review of the Atlantic Yards project is yet another stalling tactic by FCRC and ESDC that undermines the protection of the community provided by the New York State Supreme Court. Also, the community continues to wait for Governor Cuomo to follow through on his promises to reform State government, and make the Atlantic Yards project a benefit for Brooklyn.”

Forest City Ratner (FCR) Companies will provide free waste receptacles to tenants, superintendents, and building owners near the Atlantic Yards project in an effort to address the Prospect Heights rodent infestation.
Health Department-approved lidded, heavy-duty trash cans are being offered by FCR to help keep rodents away from buildings.
**To be eligible, your building must be located: south of Atlantic Avenue from 4th Avneue to Vanderbilt Avenue; Vanderbilt Avenue from Atlantic Avenue to Bergen Street; Bergen Street from Vanderbilt Avenue to 4th Avenue; 4th Avenue (East side only) from Bergen Street to Atlantic Avenue.
How to get your free garbage can:
1. Make sure your building is located within the boundaries and has 12 units or fewer;
2. At pick-up, provide photo ID and proof of address by showing a utility bill with your unit number dated within the last three months;
3. Visit the Atlantic Yards Community Liaison Office located in the trailer on Carlton Avenue (between Pacific and Dean Streets).

AY Rodent Control Meeting Report

ATLANTIC YARDS RODENT CONTROL MEETING REPORT
This past week, Council Member Letitia James, representatives from City Council Member Steve Levin’s Office, State Senator Velmanette Montgomery’s Office, other community leaders and stakeholders met with ESDC, City agencies and Forest City Ratner Companies (FCR) at an Atlantic Yards Cabinet Meeting in Brooklyn. The meeting’s focus was on rodent infestation, which has become a serious concern in the Atlantic Yards footprint and surrounding community.
Recently, neighbors of Dean Street near the Atlantic Yards project have reported cat-size rats and an uptick in the rat population. Many have expressed concerns about the rodent population’s increase in the neighboring homes and streets surrounding the construction site. A common notion has been that rats have not been a problem until the arena’s construction, while others have referred to it as a “rat tsunami.”
During the meeting, a New York City Department of Health rodent-specialist identified a number of hotspots near the immediate area of the Atlantic Yards property. In response, Forest City Ratner stated they would provide vouchers for the community to purchase special trash cans that could contain and deter rodents. Forest City Ratner agreed to work with Colony, a pest management company, which provides integrated pest management to alleviate the situation through education, outreach, and bait control. The MTA representative in attendance also shared that employees would continue to check rat bait traps every thirty to forty days in subway stations located near Atlantic Yards.
The Department of Sanitation reported that certain recommendations would be made for homeowners in this Prospect Heights area. These include that all garbage in cans be placed on the street at or around 9 p.m. Another recommendation is garbage be put in secured cans (which would be enforced by the Sanitation Department). Forest City Ratner also stated it would lead a new initiative that separates the food waste from the construction garbage on the Atlantic Yards site.
“I appreciate Forest City Ratner’s cooperation, as well as FCR taking action on the rodent control problem. Also, I look forward to starting the process of providing vouchers to residents for steel or rubber trash cans within the next two weeks, as well as educating the public at large about this ongoing problem,” said Council Member James.
Other Prospect Heights’ issues discussed at the meeting include Council Member James’ goal to secure a new dumpster for Engine 219 and Ladder 105 on Dean Street. She also seeks funding for improvement of conditions at the Dean Street playground. Lastly, the abandoned properties near the Atlantic Yards Arena need to be addressed as possible breeding grounds of the rat population.

As former president of the Brooklyn Chamber of Commerce and Director of the MetroTech Business Improvement District in downtown Brooklyn, Ken recognizes that small businesses serve as an economic engine in Brooklyn.
The community looks forward to partnering with an innovative leader to resolve outstanding issues in and around the Atlantic Yards footprint. I’m confident that Ken will address the high rate of unemployment in Central Brooklyn, the lack of procurement for minority and women owned businesses in the state of New York, as well as the impact of the recession on all small businesses.

Congratulations to DDDB and Community on Ruling Against Atlantic Yards Development
State Supreme Court Justice Marcy S. Friedman issued a ruling today granting the motion by Develop Don't Destroy Brooklyn (DDDB), and other petitioners. The judge sided with DDDB and associated neighborhood groups stating that the Empire State Development Corporation (ESDC) did not properly consider the full 25-year schedule of the Atlantic Yards development project. The judge sent the case back to ESDC requiring a detailed, reasoned basis for its findings and support.
Justice Friedman criticized ESDC for the lack of transparency in its approval of Bruce Ratner’s Atlantic Yards project, highlighting that the environmental review process is meant to be an open process involving the public, as well as other interested agencies.
“The Court properly found that ESDC misrepresented the facts of the contracts and there were no requirements that FCRC complete the project,” said DDDB lead counsel Jeffrey S. Baker of the Albany, New York law firm of Young, Sommer, Ward, Ritzenberg, Baker & Moore, LLC. “ESDC’s lack of transparency was not just with respect to its own deliberations, but extended to trying to hide material facts from the Court. We are very pleased that Justice Friedman did not tolerate that behavior.”
Council Member Letitia James said: “It’s time that Forest City Ratner Corporation sit down with the community and incorporate aspects of the UNITY plan into his project, which focuses on affordable housing and buildings that compliment the community. Unfortunately, the taking of homes and businesses by eminent domain in absence of proper findings has already happened. I hold my ground and continue my objection to this entire development, the process, the land grabbing, and the waste of public funds. In light of Justice Friedman’s ruling, it’s critical that Governor Elect Andrew Cuomo examine the overall plan for the Atlantic Yards project, and meet with the community. Lastly, congratulations to DDDB, Prospect Height Neighborhood Development Council, and the community for their perseverance and victory.”

NEW YORK, New York– On Thursday, June 24 at noon, busloads of Brooklyn residents will travel across the Brooklyn Bridge to Madison Square Garden with area clergy members, lead by Pastor Clinton M. Miller of Brown Memorial Baptist Church, and elected officials to protest the NBA’s decision to accept Mikhail Prokhorov as the majority owner of the Nets basketball franchise.
In a tersely worded letter signed and delivered to NBA Commissioner David Stern, more than 300 residents, community organizations and congregations have called on Commissioner Stern to open a thorough investigation of Prokhorov and Renaissance Capital, an investment bank of which he is part owner. It is alleged that Renaissance Capital violated U.S. sanctions against Zimbabwe.
According to the letter, “…it is only fitting that the league should respect global human rights. Anything less would be morally wrong and could potentially ensnare the NBA, its member clubs, and personnel in complex international human rights violations…”
The Nets were purchased by Forest City Ratner Companies in 2004 as part of a package development deal called Atlantic Yards. Finally passing many hurdles – including community opposition – the controversial development has begun. The Nets are expected to play in Brooklyn by the 2012 season.

Dear Mr. Stern:
This letter is being sent to express concerns about the National Basketball Association's pending agreement with Mikhail Prokhorov, who seeks to buy the New Jersey Nets basketball team. In a recent interview, you anticipated that Mr. Prokhorov could be sitting among the NBA's team owners during the draft lottery on May 18, despite the possibility that he may have violated United States sanctions against Zimbabwe that have been in place since 2003.
Brooklyn elected officials are disappointed that you are so eager to close the deal with Mr. Prokhorov, as your statement implies, rather than vet the details of a prospective team owner's dealings in a nation run by Robert Mugabe's oppressive dictatorship.
The Nets basketball team is an integral part of the Atlantic Yards redevelopment project - a project that was sold to the public as one that would provide many benefits to New Yorkers, including the creation of thousands of affordable housing units. As elected representatives of the community, we have a significant responsibility to ensure that the public is served through the most honorable means possible.
Congressman Bill Pascrell of New Jersey has asked you to keep your stated commitment to perform due diligence of Mr. Prokhorov and he has called upon the Treasury Department to investigate whether sanctions have been violated. The signers of this letter share Congressman Pascrell's belief that the NBA should hold a higher standard for its business partners than simply avoiding doing business with convicts.
Rep. Pascrell wrote to you explaining that as a 50 percent owner of Renaissance Capital, Mr. Prokhorov is directly connected to the firm's reported sponsorship in June 2009 of an economic forum in Harare, Zimbabwe. Renaissance Capital offered foreign investors special access to government officials, including those on the United States' sanctions list, and is also reportedly a shareholder in CBZ Holdings, one of the largest banks in Zimbabwe. The Government of Zimbabwe is the bank's largest shareholder.
The congressman also made you aware of his findings that Renaissance may have long-standing working relationships with major Russian fraud scheme, based on documents filed last year in the Southern District of New York. The court filings detail Renaissance's connection to a complex tax rebate fraud in Russia through which it is believed at least $106.9 million in taxes paid from a Renaissance-managed investment fund was later embezzled from the Russian treasury through the payment of fraudulent tax refunds.
The public benefits of Atlantic Yards will be hollow if they are achieved with the help of profits gained through fraudulent schemes or a regime that holds no regard for human rights.
We ask that you postpone the NBA owners' vote to ratify Mikhail Prokhorov as owner of the New Jersey Nets until his business background is thoroughly understood.
